- Payments are non-refundable. We may, at our discretion, issue account credit.
- Chargebacks are prohibited and incur a £200 administrative fee in addition to the disputed amount.
- By purchasing game hosting or dedicated servers you agree services may begin immediately and you waive the 14-day cancellation right.
1. Acceptance of Terms
By creating an account or purchasing services from Sunnyside Hosting ("we", "us"), you accept and agree to be bound by these Terms of Service ("TOS"). If you do not agree, do not use our services.
2. Services Provided
We provide game hosting (multiplayer server hosting), dedicated servers (leased hardware), and related hosting services. We may modify or discontinue services at any time.
2.1 Service Costs
Our services require upfront payments to third-party providers (servers, bandwidth, software licenses). Because of these costs, payments are final and non-refundable as set out below.
3. Payment & Billing
3.1 Payment Terms
- All payments must be made in full before services are provisioned.
- Services will not be activated until payment has cleared.
3.2 No Refunds
All payments to Sunnyside Hosting are final and non-refundable. Account credit may be issued at our discretion for service failures or exceptional circumstances, but cash refunds will not be provided.
3.3 Chargebacks
Chargebacks are strictly prohibited. If you initiate a chargeback you acknowledge and agree that:
- Your account may be immediately suspended.
- A non-refundable administrative fee of £200 will be charged on top of the disputed amount.
- Failure to pay the chargeback fee may result in debt recovery action and further legal costs.
4. Service Provisioning & Cooling-Off Period
Game hosting and dedicated servers are normally provisioned immediately after payment. By purchasing these services you agree which you consent to the immediate start of the service and therefore waive the 14-day cooling-off right under UK consumer law for these purchases.
5. Account Responsibility & Security
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity on your account, whether authorised by you or not. Notify us immediately of any suspected unauthorised access.
6. Acceptable Use
You may not use our services to:
- Commit illegal activity under UK law.
- Host or distribute malware, or facilitate cyber attacks (DDoS, brute force etc.).
- Send spam or unsolicited bulk communications.
- Infringe third-party intellectual property rights.
Violation of these rules may result in suspension or termination without refund.
7. Termination
We may suspend or terminate accounts for non-payment, breaches of the TOS or abuse. No refunds will be provided on termination unless expressly stated by us in writing.
8. Limitation of Liability
Services are provided "as is". We are not liable for indirect, incidental, special or consequential losses. Our total liability to you for any claim arising from these TOS will not exceed the total amount you paid to us in the 12 months before the claim.
9. Changes to These Terms
We may update these TOS from time to time. We will post the updated TOS on our site. Continued use of our services constitutes acceptance of those changes.
10. Governing Law
These terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction.
